Frequently Asked Questions

Why is my background check taking so long?

Most background checks are completed within 24 to 72 hours. However, delays frequently occur if we require physical court runners to pull files in counties that have not digitized their records, or if we are waiting on a past employer or university to return our verification calls.

Will I be notified if my background check causes me to lose a job offer?

Yes. Under the FCRA, if an employer intends to take "adverse action" (like rescinding a job offer) based on the results of our report, they are legally required to provide you with a Pre-Adverse Action notice, a copy of the report, and a summary of your rights before making their final decision.

How long does the dispute process take?

Once you submit a formal dispute through the portal below, federal law allows up to 30 days to complete a re-investigation. However, our compliance team prioritizes disputes and strives to resolve them much faster by verifying the data directly with the original public record source.

Can PBS make the hiring decision or override the employer?

No. Proficiency Background Services functions solely as a Consumer Reporting Agency. We securely gather and provide factual public records to the employer. We do not evaluate the results, and we have zero input into the final hiring decision made by the organization.

Your Legal FCRA Rights

Proficiency Background Services acts as a third-party Consumer Reporting Agency (CRA). We collect public records on behalf of your prospective employer. We do not make hiring decisions.

If an employer takes adverse action based on your report, you have specific legal rights:

  • You must be notified by the employer and provided a copy of the report.
  • You must be provided a document titled "A Summary of Your Rights Under the FCRA."
  • You have the right to dispute inaccurate information directly with us.

Upon receiving a dispute, our compliance team will instantly open a re-investigation into the public record at absolutely no cost to you.
